1. SPOUSAL VISA: SECTION 18 OF THE IMMIGRATION ACT 13 OF 2002, AS AMENDED

  • Applicant is prohibited from working, conducting own business or studying in the Republic
  • Applicant must prove that they are married to a South African citizen or permanent resident; or
  • Applicant must prove that they have entered into a Notarial Life Partnership Agreement which confirms that they have been in a relationship for at least 24 months
  • Applicant’s spouse must take financial responsibility for the applicant and prove that he or she earns an income of at least R8500 per month
  • Visa is valid for 2 (two) years and is renewable
  • After 5 (five) years of marriage or Life Partnership contract, the applicant will be eligible to apply for Permanent Residency in accordance with Section 26(b) of the Immigration Act

2. SPOUSAL VISA: SECTION 11(6) OF THE IMMIGRATION ACT 13 OF 2002, AS AMENDED

  • Applicant is permitted to work, conduct own business or study in the Republic
  • Applicant must prove that they are married to a South African citizen or permanent resident; or
  • Applicant must prove that they have entered into a Notarial Life Partnership Agreement which confirms that they have been in a relationship for at least 24 months
  • Applicant must attach proof of employment; own business; or studies to their application
  • Visa is valid for 2 (two) years and is renewable
  • After 5 (five) years of marriage or Life Partnership contract, the applicant will be eligible to apply for Permanent Residency in accordance with Section 26(b) of the Immigration Act

3. RELATIVE’S VISA (SIBLING): SECTION 18 OF THE IMMIGRATION ACT 13 OF 2002, AS AMENDED

  • Applicant is prohibited from working, conducting own business or studying in the Republic
  • Applicant must prove that they are the biological sibling of a South African citizen or permanent resident by attaching birth certificates confirming that they have the same parents
  • The South African citizen must take financial responsibility for the applicant and prove that he or she earns an income of at least R8500 per month
  • Visa is valid for 2 (two) years and is renewable
  • Applicant is not authorised to apply for Permanent Residency

4. RELATIVE’S VISA (PARENT OF MINOR/ MAJOR CHILD): SECTION 18 OF THE IMMIGRATION ACT 13 OF 2002, AS AMENDED

  • Applicant is prohibited from working, conducting own business or studying in the Republic
  • Applicant must prove that they are the biological parent of a South African citizen or permanent resident by attaching their birth certificate
  • The South African citizen or permanent resident must take financial responsibility for the applicant and prove that he or she earns an income of at least R8500 per month
  • Visa is valid for 2 (two) years and is renewable
  • Applicant is authorised to apply for Permanent Residency in accordance with Section 27(g) of the Immigration Act

5. RELATIVE’S VISA (MINOR/ MAJOR CHILD): SECTION 18 OF THE IMMIGRATION ACT 13 OF 2002, AS AMENDED

  • Applicant is prohibited from working, conducting own business or studying in the Republic
  • Applicant must prove that they are the biological child of a South African citizen or permanent resident by attaching their unabridged birth certificate
  • The South African citizen or permanent resident must take financial responsibility for the applicant and prove that he or she earns an income of at least R8500 per month
  • Visa is valid for 2 (two) years and is renewable
  • Applicant is authorised to apply for Permanent Residency in accordance with Section 27(g) (major child), Section 26(c) (minor child <21) or Section 26(d) (child of a citizen) of the Immigration Act

6. CRITICAL SKILLS VISA: SECTION 19(4) OF THE IMMIGRATION ACT 13 OF 2002, AS AMENDED

  • Applicant may only apply for this visa if their qualifications, skills and job title reflect a position listed on the Critical Skills list published during August 2022 in the Government Gazette
  • Applicant must prove post-qualification experience of 5 (five) years
  • The visa is issued for 5 (five) years and is renewable
  • Applicant must include a job offer in the case of an initial application
  • For a renewal application, the applicant must include a contract of employment
  • SAQA verification is required should the applicant hold foreign qualifications
  • Applicant may apply for Permanent Residency in accordance with Section 27(b) should they meet the requirements for same
